1) Who we are

VisaFard (“we,” “us,” “our”) is a for-profit company that provides guidance and software tools to help users prepare for and, if authorized, complete and submit their U.S. Diversity Visa (“DV Lottery”) entry. We are not affiliated with the U.S. government and do not control the DV program.

2) Scope of services; no government affiliation

We provide (i) informational content and checklists; (ii) utilities (address/date converters, photo compliance checks); and (iii) paid preparation and filing services. Official DV rules, dates, and portals are determined solely by the U.S. government.Any references to timeframes are informational—always verify on the official site.

3) Authorization to act on your behalf

Where you purchase a filing service, you authorize us to use the information you provide to prepare, complete, and submit your DV entry on your behalf to the official government portal, and to communicate with you about that submission. You remain solely responsible for the accuracy and completeness of your information and for monitoring your case status and results.

No success guarantee. Using an agent or preparer does not increase your chance of selection or visa issuance.

4) Eligibility and user warranties

  • You are at least the age of majority and legally able to enter these Terms.
  • You provide accurate, current, and complete information and documents.
  • You have the legal right to share all data you submit (including photos).
  • You understand the DV program may change, pause, or be canceled by authorities.

5) Fees, payments, refunds & chargebacks

  • Service fees. Our preparation/filing services are paid to us and are distinct from any official government fees, which are paid directly to the government portal if required.
  • Payment processing. We process payments via third-party processors. You authorize charges to your selected payment method and agree to pay any applicable taxes and currency conversion costs.
  • Iran & sanctioned payment sources. We do not accept payments originating from Iran or other comprehensively sanctioned jurisdictions or parties (see §6).
  • Refunds. Unless stated otherwise in an applicable offer, service fees are non-refundable once preparation begins or a submission attempt has been made. If we are unable to submit due solely to our error and you do not wish to reattempt, we may provide a refund of the affected service fee.
  • Chargebacks. You agree to contact us first to resolve billing issues. Unfounded chargebacks may be contested and could result in account suspension.

6) Sanctions/OFAC, export controls & prohibited use

We comply with U.S. sanctions and export-control laws, including OFAC regulations. We do not do business with, or accept payments from, persons or entities located in or ordinarily resident in comprehensively sanctioned jurisdictions (including without limitation Iran, Cuba, North Korea, Syria, or Crimea/Donetsk/Luhansk regions of Ukraine) or from individuals on applicable sanctions lists.

We may employ geolocation, BIN checks, billing-address review, IP intelligence, and sanctions screening. We may decline or terminate services if we cannot verify compliance.

7) Your responsibilities & confirmations

  • Review drafts promptly; respond to document/photo requests and deadlines.
  • Keep your confirmation number and access credentials private and secure.
  • Promptly notify us of errors; we rely on your timely cooperation.
  • Maintain current contact details so we can reach you.

8) Acceptable use & prohibited conduct

  • No unlawful, fraudulent, deceptive, or abusive use of the Service.
  • No uploading malware, infringing content, or others’ data without consent.
  • No interference with our systems or attempts to circumvent controls.
  • No misrepresentation of affiliation with us or the U.S. government.

9) Intellectual property & license

The Service and its content (text, UI, logic, and branding) are protected by IP laws. We grant you a limited, revocable, non-transferable license to use the Service for your personal, non-commercial use. Do not copy, modify, or distribute our content without written permission, except as permitted by law.

10) Third-party services & government portals

We use third-party providers (e.g., payment, analytics, security). Government websites are third-party sites. Their terms and privacy policies apply, and we are not responsible for their content or availability.

11) No guarantees; informational nature

We do not guarantee selection in the DV program, visa issuance, or any outcome. Content is general information and not legal, immigration, or professional advice. Consult your own qualified advisor for advice about your particular situation.

12) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT INFORMATION WILL ALWAYS BE CURRENT OR ACCURATE.

13) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR REVENUE. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED US$100 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, WHICHEVER IS GREATER.

14) Indemnification

You agree to defend, indemnify, and hold harmless VisaFard from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your data, or your breach of these Terms or applicable law.

15) Changes to the Service and these Terms

We may modify or discontinue features and update these Terms at any time. We will adjust the “Last updated” date. Continued use constitutes acceptance of changes.

16) Governing law, venue & dispute resolution

These Terms are governed by the laws of California, United States without regard to conflicts-of-law rules. Disputes shall be resolved in The exclusive forum and venue for any dispute shall be the state or federal courts located in San Francisco County, California, and the parties consent to personal jurisdiction there. Each party waives any objection to inconvenient forum. A party may still pursue an individual claim in small claims court.. To the extent permitted, you waive class actions and jury trial.
